Terms of Service

All services provided by AlphaVPS (DA International Group Ltd.) may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any European Union law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless AlphaVPS (DA International Group Ltd.) from any claims resulting from the use of service which damages the subscriber or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to AlphaVPS (DA International Group Ltd.)'s servers, or any other server on the Internet. Links to such materials are also prohibited.

The following are strictly prohibited uses and may result in immediate suspension and/or termination if discovered on Your account:

  • On VPS only: CPU and I/O intensive operations, unless specifically stated that the services comes with DEDICATED CPU cores.
  • Any other activities forbidden by law
  • Malware, Phishing and malware distribution websites
  • Artificial traffic creation
  • Booter / Stresser websites
  • Fake / Replica product websites
  • IP spoofing
  • Virtual currency (*coin) mining
  • Illegal downloads / Piracy
  • CSAM
  • Pornography
  • Mass emailing / Spamming. Personal mail servers are permitted
  • Illegal Torrents
  • PUBLIC TOR/VPN/Proxy/Any kind of anonymity services (VPN and Proxy usage is fine if they are only used by the customer)
  • Port scanning
  • Denial of Service (DoS) attacks

NOTICE: If your account is found to be conducting illegal activities, hosting copyrighted content or otherwise performing actions against the law, we may immediately suspend or terminate the account with or without prior notice, depending on the TOS violation. That being said - AlphaVPS (DA International Group Ltd.)'s team would not scan manually through the end user's files. Actions shall be taken if a valid abuse report is received, a court order is received or legal authorities request this to be done. Accounts suspended or terminated due to breaching our Terms of Service will not be entitled to a refund.

Order Verification and Customer Information

All orders placed with AlphaVPS are subject to manual verification to ensure compliance with our security standards and to prevent fraudulent activities.

Customers are required to provide complete and valid contact information during the order process. This information is essential for accounting purposes and to maintain effective communication. All anonymous orders would be rejected.

Depending on various risk factors, certain orders may be subject to additional identity verification procedures, commonly known as Know Your Customer (KYC) checks. These measures are implemented to verify the identity of our customers and to comply with legal and regulatory requirements.

Traffic Usage

All account plans come with a predetermined monthly amount of traffic allowance. We charge 3.0EUR additional per TB over the allowance, unless otherwise agreed upon.

IRC

We allow IRC to be hosted on our servers, as long as it is used for lawful purposes.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of AlphaVPS (DA International Group Ltd.) is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund. All services must be used for lawful purposes only.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Billing

By the Account Activation Date of each month, AlphaVPS (DA International Group Ltd.) shall: Deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to AlphaVPS (DA International Group Ltd.) by no later than the specified payment due date. AlphaVPS (DA International Group Ltd.) shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a monthly / quarterly / semi-annual or annual basis, 14 days prior the actual due date, unless otherwise specified. Payment delays should be explained via a ticket, to avoid service suspend/terminate.

Money Back Guarantee & Refund Policy

We do offer a 14-days refund policy on the FIRST order for the specific account, unless otherwise specified, if none of the resources were used. Should there have been an abuse or breach of our TOS on the account - no refunds shall be given. We do not refund cancelled services. For example, if your service is quarterly and you request a refund after two months, no refunds will be given. No refunds are issued for setup charges, add-on charges, domain-registrations, add-on purchases, SSL certificates or overage charges. In case of AUP violations, any and all refunds are forfeit.

Promotional plans are non-refundable. If the plan is listed under a special category, on a lower price than regular one - it's deemed promotional.

Orders originating from China are excluded from the refund policy and these orders would not be applicable for a refund.

Dedicated servers which require a custom setup, order of additional parts or take a longer than usual time to build are not entitled to a refund.

Storage VPS servers are entitled to 24-hour refund period, which applies to the first order only.

Cryptocurrency payments are non refundable and final.

Account Deactivations

Any account deactivated due to non-payment will require all invoices to be paid in full before using our services again.

Cancellation Refunds

We do not refund partial monthly fees to accounts. We require 14 days notice for a cancellation.

Limitation of Liability

AlphaVPS (DA International Group Ltd.) shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from AlphaVPS (DA International Group Ltd.)'s servers going off-line or being unavailable for any reason whatsoever. Furthermore, AlphaVPS (DA International Group Ltd.) shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of AlphaVPS (DA International Group Ltd.)'s servers. All damages shall be limited to the amount paid for the current term of service. AlphaVPS (DA International Group Ltd.) shall not be responsible for any damages, claimed due a mis-use of their servers by end clients.

Violations

Violations of these Acceptable Use Policies should be referred to [email protected]. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer

AlphaVPS (DA International Group Ltd.) cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain equipment, routing, software and programming used by AlphaVPS (DA International Group Ltd.) are not directly owned or written by AlphaVPS (DA International Group Ltd.). Moreover, AlphaVPS (DA International Group Ltd.) holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as AlphaVPS (DA International Group Ltd.) sees fit.

Account Registration

By registering your account with AlphaVPS (DA International Group Ltd.), you agree to the above policies and disclaimer. Upon registration of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

Server Uptime Guarantee

AlphaVPS (DA International Group Ltd.) guarantees 99.9% service uptime on all hosting plans and VPS plans. For full SLA details and credit schedules, see our Service Level Agreement.

Backups and Data Loss

AlphaVPS (DA International Group Ltd.) is in no way responsible for any data loss, which can be caused by various reasons, including but not limited to: Server hardware failure, user container being hacked. However we do take complimentary backups of our servers on our own good will. AlphaVPS (DA International Group Ltd.) reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
